{"id":952,"date":"2022-05-06T09:15:06","date_gmt":"2022-05-06T09:15:06","guid":{"rendered":"https:\/\/afisk.es\/coneix-els-nous-requisits-de-contractacio\/"},"modified":"2022-05-06T09:15:06","modified_gmt":"2022-05-06T09:15:06","slug":"coneix-els-nous-requisits-de-contractacio","status":"publish","type":"post","link":"https:\/\/afisk.es\/ca\/coneix-els-nous-requisits-de-contractacio\/","title":{"rendered":"Coneix els nous requisits de contractaci\u00f3"},"content":{"rendered":"<p>El 31 de mar\u00e7 de 2022 va entrar en vigor la reforma laboral establerta al <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2021-21788\" target=\"_blank \" rel=\"noopener\">Reial decret llei 32\/2021<\/a> en qu\u00e8 s&#8217;inclouen nous requisits de contractaci\u00f3, i que afecta els nous contractes efectuats des d&#8217;aquesta data (tant a tipus contractes temporals com indefinits o en formaci\u00f3). Aquestes s\u00f3n les novetats que ens porta aquesta reforma.<\/p>\n<p>En principi <strong>a partir del 31 de mar\u00e7 tots els contractes efectuats hauran de ser indefinits a excepci\u00f3 d&#8217;un sol tipus de contracte temporal<\/strong> que es pot aplicar per dos motius: <strong>Per circumst\u00e0ncies de la producci\u00f3 o per substituci\u00f3 <\/strong>.<\/p>\n<h2>Com s\u00f3n els nous contractes temporals<\/h2>\n<h3>Per circumst\u00e0ncies de la producci\u00f3<\/h3>\n<p>Cobreix l&#8217;increment de producci\u00f3 produ\u00eft per una circumst\u00e0ncia excepcional i, sempre abans, <strong>haur\u00e0 d&#8217;estudiar-se la possibilitat de cobrir la vacant amb un contracte fix discontinu<\/strong>. Hi ha <strong>dues modalitats d&#8217;aquest contracte depenent de si les causes que determinen l&#8217;increment s\u00f3n previsibles o no<\/strong>.<\/p>\n<ol>\n<li>En cas que la <strong>causa sigui previsible, i s&#8217;estimi d&#8217;una durada curta i determinada<\/strong>, el contracte pot ser de <strong>90 dies<\/strong> (l&#8217;any natural) . No es pot utilitzar de manera continuada.<\/li>\n<li>En el cas d&#8217;un <strong>augment imprevisible que altera l&#8217;activitat natural de l&#8217;empresa<\/strong> es pot contractar <strong>temporalment fins a 6 mesos ampliables a un any.<\/strong><\/li>\n<\/ol>\n<h3>Contracte de substituci\u00f3<\/h3>\n<p>S&#8217;utilitza, com fins ara, <strong>per cobrir temporalment una persona o per completar en el cas de reduccions de jornada<\/strong>. Tamb\u00e9 serveix per a <strong>cobrir temporalment una pla\u00e7a durant un proc\u00e9s de selecci\u00f3 o promoci\u00f3<\/strong>.<\/p>\n<h2>Dos tipus de contracte de formaci\u00f3<\/h2>\n<p>La reforma determina dos nous requisits per a aquests tipus de contractaci\u00f3: la formaci\u00f3 en alternan\u00e7a o dual i la per a l&#8217;obtenci\u00f3 de pr\u00e0ctica professional.<\/p>\n<h3>Formaci\u00f3 en alternan\u00e7a<\/h3>\n<p>Combina feina amb formaci\u00f3. En aquest cas, <strong>el temps dedicat a la feina no pot ser superior al 65% de la jornada estipulada per conveni durant el primer any, ni al 85% durant el segon<\/strong>. Aix\u00ed mateix, <strong>la retribuci\u00f3 tamb\u00e9 est\u00e0 regulada per aquest i mai no pot ser inferior al salari m\u00ednim<\/strong>.<\/p>\n<p>La durada establerta per al contracte de formaci\u00f3 en alternan\u00e7a \u00e9s <strong>d&#8217;entre 3 mesos i dos anys.<\/strong><\/p>\n<h3>Per a l&#8217;obtenci\u00f3 de pr\u00e0ctica professional<\/h3>\n<p>Nom\u00e9s es podr\u00e0 optar a aquest tipus de contractaci\u00f3 <strong>en els 3 anys seg\u00fcents a lobtenci\u00f3 del t\u00edtol<\/strong>. Aquests contractes tenen <strong>una durada entre 6 mesos i 1 any<\/strong>.<\/p>\n<p>Pots descarregar aqu\u00ed els <a href=\"https:\/\/www.sepe.es\/HomeSepe\/empresas\/Contratos-de-trabajo\/modelos-contrato\/modelos-contrato-prtr.html\" target=\"_blank\" rel=\"noopener \">impresos dels nous contractes formalitzats dins del Pla de Recuperaci\u00f3, transformaci\u00f3 i resili\u00e8ncia<\/a>.<\/p>\n<h2>Un nou tipus de contractaci\u00f3 al sector de la construcci\u00f3<\/h2>\n<p>A partir de la reforma <strong>un empleat del sector de la construcci\u00f3 t\u00e9 dret a la recol\u00b7locaci\u00f3 en una obra diferent quan finalitzi la seva feina a l&#8217;actual<\/strong>. Aix\u00f2, \u00e9s clar, <strong>sempre que hi hagi obres en curs a la mateixa prov\u00edncia o que no hi hagi possibilitat de recol\u00b7locaci\u00f3 a les existents ni tan sols requalificant-ho<\/strong>.<\/p>\n<h2>Afisk la teva assessoria laboral<\/h2>\n<p>Com veus, aquesta darrera reforma laboral ha afectat les noves contractacions.
